Purity Plumbing – Terms & Conditions
These Terms & Conditions apply to plumbing, drainage, gas fitting, maintenance, installation, repair and associated services supplied by Purity Plumbing (“Purity Plumbing”, “we”, “us” or “our”) to the customer (“Customer”, “you” or “your”).
By accepting a quotation, approving works, booking our services or instructing Purity Plumbing to commence work, the Customer agrees to these Terms & Conditions, subject to any rights that cannot lawfully be excluded.
1. Quotations & Upfront Pricing
Purity Plumbing operates an upfront quoting system wherever reasonably possible.
Before commencing quoted works, we will provide the Customer with the price and scope of work for approval.
Unless otherwise stated, quotations are based on the information and site conditions reasonably available to us at the time of quoting.
A quotation only includes the works specifically described within it.
Additional work, materials or services outside the quoted scope will be treated as a variation and may incur additional charges.
Unless otherwise stated, quotations are valid for 30 days.
2. No Call-Out Fee
Where Purity Plumbing advertises or offers “No Call-Out Fee”, this means no separate fee is charged simply for travelling to and attending the property during the conditions applicable to that offer.
It does not mean that diagnostic work, labour, materials, specialist equipment, emergency works or repairs are provided free of charge.
Any applicable charges will be explained to the Customer before chargeable works proceed wherever reasonably practicable.
3. Free Home Plumbing Inspections
Any complimentary or free plumbing inspection offered by Purity Plumbing is a general visual inspection of reasonably accessible plumbing fixtures and services.
Unless specifically stated otherwise, a free inspection does not include dismantling fixtures, invasive investigation, CCTV drain inspections, high-pressure water jetting, electronic leak detection, excavation, testing requiring specialist equipment or other diagnostic work.
A free inspection is not a building inspection, engineering inspection or guarantee that all existing or future plumbing defects will be identified.
4. Customer Approval
The Customer, property owner or authorised representative must approve the quoted works before Purity Plumbing proceeds.
Approval may be provided verbally, electronically, by accepting a quotation or by otherwise instructing us to proceed.
The person approving the work confirms that they have authority to authorise the work and accept the associated charges.
5. Payment
Unless otherwise stated in writing, payment is due upon completion of the works or by the due date stated on the invoice.
Available payment methods may include EFTPOS, electronic bank transfer or other methods nominated by Purity Plumbing.
The Customer must pay all amounts properly due under the agreed quotation, approved variations and invoice, subject to the Customer’s rights under applicable law.
6. Overdue Accounts
Invoices not paid by the stated due date will be considered overdue.
Purity Plumbing may issue payment reminders, suspend further non-emergency work where legally permitted and pursue available debt recovery or other lawful remedies.
Where permitted by law and the applicable agreement, the Customer may be responsible for reasonable costs incurred by Purity Plumbing in recovering an overdue debt.
Nothing in this clause limits any statutory rights or obligations applying to payment claims or payment disputes.
7. Retention of Title – Materials & Equipment
To the extent permitted by law, materials, fixtures, fittings, equipment and goods supplied by Purity Plumbing remain the property of Purity Plumbing until all amounts owing in respect of those goods have been paid in full.
Where goods remain the property of Purity Plumbing and can lawfully be recovered, Purity Plumbing may require the Customer to make those goods available for collection following reasonable notice.
Purity Plumbing will not enter private property, remove goods that have become fixtures or otherwise recover installed materials unless Purity Plumbing has a lawful right to do so.
Recovery of any goods does not automatically extinguish the Customer’s outstanding account. Any amount remaining payable will be determined having regard to the value of goods recovered and applicable law.
8. Deposits
Where a deposit is required, the amount and due date will be stated on the quotation or contract.
Purity Plumbing will comply with any statutory limitations applying to deposits for regulated building work.
Special-order or custom materials may require payment before ordering, where permitted by law.
9. Variations & Additional Works
Plumbing work can reveal conditions that could not reasonably be identified before work commenced.
Examples include concealed leaks, damaged or non-compliant pipework, tree-root intrusion, collapsed drainage, asbestos-containing materials, inaccessible services, underground obstructions, structural issues and undocumented plumbing.
If additional work is required, Purity Plumbing will explain the issue and obtain approval for the variation where required before proceeding, except where immediate work is reasonably necessary to make the property safe or prevent further damage and the law permits that work.
Variations may result in additional charges and changes to the expected completion time.
10. Site Access
The Customer must provide safe and reasonable access to the property and work area at the agreed time.
The Customer is responsible for ensuring Purity Plumbing has permission to access areas necessary to complete the approved works, including any neighbouring property where applicable.
Additional costs may apply where works are delayed or cannot proceed because suitable access has not been provided.
11. Concealed & Unknown Services
Purity Plumbing will take reasonable care when carrying out excavation, cutting, drilling and demolition.
The Customer should advise us of any known concealed electrical, water, gas, communications, irrigation or other services before work commences.
Purity Plumbing is not responsible for inaccurate or incomplete information concerning concealed services supplied by the Customer or third parties, subject to our own obligation to exercise due care and skill.
12. Excavation & Reinstatement
Where excavation, cutting, drilling or demolition is required, Purity Plumbing will take reasonable care to minimise disturbance.
Unless specifically included in the quotation, pricing does not include specialist reinstatement or exact matching of:
- tiles;
- concrete finishes;
- paving;
- landscaping;
- turf or gardens;
- cabinetry;
- paint;
- plaster;
- waterproofing; or
- other decorative finishes.
Where reinstatement is included, reasonable efforts will be made to provide an appropriate finish; however, exact matching of existing aged materials, colours, textures or finishes cannot always be guaranteed.
13. Drain Clearing
Drain clearing removes or relieves an existing blockage but does not guarantee that a drain will remain blockage-free.
Recurring blockages may result from damaged, collapsed, incorrectly installed or deteriorated pipework, tree-root intrusion, foreign objects or other underlying conditions.
Where appropriate, Purity Plumbing may recommend CCTV inspection or further investigation to identify the cause of recurring drainage problems.
14. Customer-Supplied Products
Where the Customer supplies tapware, toilets, basins, appliances, hot water systems or other products, the Customer is responsible for ensuring those products are suitable, complete and compatible with the proposed installation.
Purity Plumbing’s workmanship remains subject to applicable consumer guarantees.
Purity Plumbing is not responsible for a manufacturing defect, missing component or inherent failure of a Customer-supplied product unless the problem was caused by our installation or workmanship.
Additional charges may apply where Customer-supplied products require unexpected modifications or additional installation work.
15. Hot Water Systems & Appliances
Hot water system and appliance installations are subject to suitable existing services, site conditions, electrical supply, gas supply and manufacturer requirements.
Electrical work must be completed by an appropriately licensed electrical contractor where required.
Unless expressly included in our quotation, electrical upgrades or alterations are excluded from Purity Plumbing’s scope.
16. Gas Work
Gas fitting work will be performed by appropriately licensed persons and tested and commissioned as required.
Where existing gas installations are found to be unsafe or non-compliant, additional work may be required before the relevant appliance or service can lawfully be commissioned.
Required gas compliance documentation will be provided where applicable.
17. Compliance Documentation
Purity Plumbing will provide or lodge required plumbing, drainage or gas compliance documentation where the applicable work requires it.
Government, council, certification or statutory fees may be charged separately unless expressly included in the quotation.
18. Third-Party Trades
Some projects may require electricians, builders, roofers, tilers, waterproofers, cabinetmakers, engineers or other trades.
Unless expressly stated in the quotation, the cost and coordination of third-party trades are not included.
Where Purity Plumbing engages a subcontractor as part of our agreed scope, responsibility for that subcontracted work will be determined in accordance with the contract and applicable law.
19. Delays
Purity Plumbing will make reasonable efforts to attend and complete works within agreed timeframes.
Completion dates may be affected by weather, emergencies, material availability, supplier delays, access restrictions, unforeseen site conditions and circumstances outside our reasonable control.
We will communicate material delays to the Customer where reasonably practicable.
20. Warranties & Workmanship
Purity Plumbing stands behind the workmanship it provides.
If the Customer believes there is an issue with our workmanship, they should contact Purity Plumbing as soon as reasonably practicable and provide us with a reasonable opportunity to inspect and, where appropriate, rectify the issue.
Manufacturer warranties applying to products supplied by Purity Plumbing will continue to apply in accordance with the manufacturer’s conditions.
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, warranty or other right that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
21. Existing or Pre-Existing Defects
Purity Plumbing is responsible for the work we perform but is not responsible for unrelated defects or failures in existing plumbing, drainage, gas, electrical, structural or other building systems, except to the extent that loss or damage is caused by Purity Plumbing.
Repairing one section of an ageing system does not constitute a guarantee of the condition or future performance of the remainder of that system.
22. Photos & Documentation
Purity Plumbing may take photographs or videos before, during and after works for job records, compliance, warranty, reporting, quotation and quality-control purposes.
Images identifying the Customer or their private property will not be used publicly for advertising or promotional purposes without appropriate permission.
23. Cancellations & Rescheduling
Customers should provide reasonable notice if an appointment needs to be cancelled or rescheduled.
Purity Plumbing reserves the right, where permitted by law, to charge reasonable costs actually incurred where special-order materials have already been purchased or where substantial costs have been incurred specifically for the Customer’s approved work.
Any cancellation fee will be reasonable and consistent with applicable law.
24. Emergency & 24/7 Services
Purity Plumbing may provide emergency plumbing services outside normal business hours.
Where different after-hours or emergency rates apply, these will be disclosed to the Customer before chargeable work proceeds wherever reasonably practicable.
The availability of a 24/7 service does not guarantee immediate attendance. Attendance times depend on technician availability, location, safety and existing emergency commitments.
25. Quotation Exclusions
Unless expressly stated otherwise, quotations exclude latent or concealed defects, asbestos removal, engineering, structural repairs, specialist restoration, council works, authority fees and work by other trades.
Any exclusions specifically stated on the quotation form part of the agreement.
26. Disputes
If a Customer has a concern regarding an invoice or work completed by Purity Plumbing, they should contact us as soon as possible so that we have an opportunity to investigate and attempt to resolve the matter.
Nothing in this clause prevents either party from exercising rights available under applicable Queensland or Commonwealth legislation.
27. Limitation of These Terms
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any guarantee, condition, warranty, right or remedy that cannot lawfully be excluded, restricted or modified.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision may be severed to the extent necessary without affecting the remaining provisions.
28. Governing Law
These Terms & Conditions are governed by the laws of Queensland, Australia.
29. Acceptance
By accepting a Purity Plumbing quotation, authorising works or otherwise entering into an agreement for Purity Plumbing to provide services, the Customer acknowledges that they have had the opportunity to review these Terms & Conditions and agrees to be bound by them, subject to applicable law.
